What are the divorce laws in the United Arab Emirates?

Question

I am an UAE national that got divorced recently. My ex-wife is the one that initiated it and everything was settled in court. Im paying everything that the court ordained for her and my young son. The only thing that is making me feel uncomfortable, is the fact that the court decided to make me pay 70k a year dedicated for RENT, even though she never left her parents house and is not renting a place for her and my son. Is this the average or should I contest it since she doesn't rent? I agree with paying some amount to cover costs they might have in the family house but 70k seems a lot.

Housing allowance in UAE personal status cases is tied to the divorced mother's right to independent accommodation (nafaqat al-maskan), not to whether she's actually signed a tenancy contract. The court assumes she's entitled to her own place even if she's currently at her parents', so the fact she hasn't moved out doesn't automatically kill the order. That said, 70k a year is on the higher end for a Dubai case, it usually tracks what a comparable apartment would cost in her area, so if she's in something like Al Barsha or Mirdif that figure can look inflated. You can file an appeal or a review request arguing the amount should reflect actual need, but the burden is on you to show the figure doesn't match market rates for suitable housing.

honestly the rent part is usually the hardest to fight because UAE courts treat maskan as a standing right, not a reimbursement. if she's living with her parents that doesn't cancel it by default, but it can matter on review. 70k works out to around 5,800 a month, which is doable for a decent 1 or 2 bed in places like Al Nahda or Deira but not really enough for something like Jumeirah or Downtown, so the judge may have benchmarked it against her registered address. i'd look at the case file and see what documentation was used to set the figure, then decide if it's worth a review request. also worth checking whether the order is labeled as rent specifically or just nafaqa for housing, because that wording changes how you challenge it.

70k is what i'd call a placeholder number that judges in Dubai use when theres no tenancy contract on file. i've seen cases where the father paid 40 to 50k for a similar setup in areas like Al Qusais or Muhaisnah, and others where it hit 90k because the mother's family address was in Jumeirah. so the figure often reflects the neighborhood shes registered in, not what shes actually spending.

the angle most people miss is that nafaqat al-maskan can be paused or reduced if you can show she's been living rent free at her parents for an extended period and has no intention of moving. thats different from arguing the amount is too high. its arguing the need itself hasnt materialized. youd file a request to reconsider the nafaqa, not just appeal the number.

practically, get a copy of the judgment reasoning first. if the judge wrote something like "based on the wifes right to independent housing" without citing market rates, thats your opening. if they cited specific comparables, harder. also check if the 70k is bundled with other nafaqa or standalone, because standalone rent orders are easier to revisit than lump sums. a family lawyer in Dubai who handles personal status appeals can tell u in one meeting whether its worth the filing fee.
