I (29M) am legally married to a Thai (24F). We have a stepson (5M) and a newborn son. We are staying in a detached house that we bought under her name. Having watched "How to Make Millions Before Grandma Dies", I would like to find out if assuming I were to pass away before my wife and she does not have a will, is there any way that in the slightest chance that my stepson can take the property for himself and leave nothing to my newborn son? I do not mind a 50/50 split between them (assuming we do not have any more children) but I'm just worried that due to the infinite possibilities of unforeseen circumstances, my newborn might be cheated out of his inheritance. I actually do not understand how it is possible in the movie that the grandma was able to leave her property to the youngest son when I was under the impression that by inheritance law, it would be evenly distributed amongst the children.

Edit: The comments mentioned making a will but I would just like to check on the possibility that my son gets screwed over for any reason at all (and vice versa) assuming my wife does not gift our marital home to either of them before she passes on too. Of course, she is free to gift whoever she wants if she so wishes to.

fwiw the movie simplified a lot of stuff for drama. under thai intestate succession law if your wife dies without a will, her property gets split between her spouse (you) and her descendants equally. so your stepson and newborn would each get a share, but you as the surviving spouse also get a portion. the house being in her name alone means it's her separate property unless you can prove you contributed to buying it. if you die first, you have no claim on that house at all since it's not in your name, so your son would only inherit from your wife's estate later. the real risk is if your wife decides to gift or sell the house to the stepson before she dies, which she's legally free to do. a will from her is the only way to lock in a 50/50 split, otherwise it's up to her discretion while she's alive.

i think the laws in thailand can be complex when it comes to property ownership and inheritance, maybe check with a lawyer who specializes in thai law to get a clearer understanding of how things work in bangkok, they can probably give u a better idea of what could happen to the property if ur wife

Seems like you watched one movie and now think you understand Thai inheritance law. The movie played fast and loose with reality for dramatic effect, which is why the grandma could leave property to one kid. In real life under the Civil and Commercial Code without a will, everything gets split among legal heirs by

yeah Krua Dok Mai Kao is solid but if you're up for a detour, try Som Tum Nua near Siam Square. their som tam pu pla ra is insane if you like the fermented fish sauce kick. way more pungent than the On Nut spot, just less grilled chicken options
