Buying a Property Without Title Deed, Only Oqood?

Hi everyone,

I'm planning to buy an apartment in Dubai, but I've run into a situation and would love some advice.

The real estate agent told me that the owner of the property doesn't currently have the Title Deed. Instead, they only have the Oqood and have apparently applied for the Title Deed, which they say will take some time to process.

The agent is asking me to proceed by signing the contract (Forms) and giving the deposit cheque now, even though the Title Deed isn't ready yet.

Is this a common situation here? Is it safe to proceed with the transaction without the Title Deed? Are there any risks I should be aware of, and is there a standard way to handle this situation?

I'd really appreciate hearing from anyone who has dealt with a similar case or has experience in real estate market.

Thanks in advance!

honestly the thing nobody's mentioned yet is the mortgage angle from your side. if you're financing this, most banks in Dubai won't release funds against an Oqood, they want a proper Title Deed in the seller's name first because they need something to register their own mortgage against. so even if the seller is legit and the developer confirms everything, your bank could stall the whole thing for weeks. worth calling your mortgage advisor before you even sign the Form F, some lenders like Emirates NBD have specific rules on off-plan vs ready and it changes the rate too. if you're paying cash then ignore all that and the Oqood route is workable but make sure the deposit goes into escrow not to the agent, seen too many people lose money that way in JVC and Business Bay.

Two things worth knowing before you sign anything. First, an Oqood is registered at DLD just like a Title Deed is, so you can pull the unit status yourself on the Dubai REST app or the DLD website for a small fee, and confirm who the registered buyer actually is plus whether the unit is mortgaged. If a bank holds a mortgage on that Oqood, the seller can't transfer cleanly until it's discharged, and that's where deals like this usually blow up, not at the Title Deed stage. Second, the timeline the agent is quoting is often nonsense. Getting the deed issued after handover is usually a matter of weeks once the developer does bulk registration, not months, so ask to see the actual application reference with the developer or the trustee office. If they can't produce that, the "in process" claim is probably just talk.

Oqood means the unit is still off-plan or not yet registered at DLD, so what you're really buying is the developer's sale contract position, not a titled property. Happens a lot in projects handed over in the last year or two, especially in the southern corridors like Dubai South and parts of DAMAC and Emaar handovers where the developer hasn't finished the bulk registration. The risk sits with you if the seller's Oqood is unregistered, has unpaid installments, or if the NOC from the developer isn't issued. I'd insist on a Form F through a DLD registered broker, pay the deposit into a DLD escrow or the developer's account, not the agent's, and make the sale conditional on the Title Deed being issued and the developer's NOC being in hand before final payment. If the seller won't accept that condition, walk, there are plenty of titled units in the same buildings.

Dubai/Sharjah Road Scam?

I helped a guy stranded on the ring road, gave him a ride to Ras Al Khaima after he claimed to have lost his wallet. Turns out he was fine, just jumped out and vanished. Did I get played? damn u basically did a free taxi run to rak. thing is they usually target cars with a single guy driving & look for dubai plates so u look like u got somewhere to be. best move is roll ur window down like two inches, say u already called the cops for them & keep moving, dont even unlock the door

yeah that's a known one on e311 & the sharjah ring road, usually they wave you down near the adnoc or before the rta cameras claiming wallet got lifted. classic play is they ask for a lift to the next emirate then bail once you slow down, sometimes a second guy on a bike is tracking you. next time just call 999 or drop them at the nearest police point, don't let anyone in your car off the highway ngl

The RAK route is the tell. No one genuinely stranded on the ring road needs to get all the way to Ras Al Khaimah, that's a 90 minute drive. These guys work in pairs and the second car picks them up after they hop out, usually somewhere past the Al Sajaa junction or near the ADNOC on E311. If it happens again, tell them you'll drive them to the nearest police station and watch how fast the story changes.
