Landlord deposit dispute in Mumbai 2026

tbh the 11 month L&L actually helps u. no registered agreement means he can't just pocket it and the security deposit is supposed to be refunded within a month of you handing back keys. write him a formal letter citing the Maharashtra Rent Control Act, keep photos and the move-in inventory. if he ignores it, file with the Bandra court small causes or approach the Rent Authority. 40k is worth the ₹500 stamp paper.

Small Causes Court, not small causes, and the paint wear is normal wear and tear.

arrow_drop_up 4 arrow_drop_down

normal wear and tear is the whole argument, so get a painter's written estimate showing repainting after 2 yrs is routine & not damage. that quote is what u attach to the complaint

one thing nobody mentioned, ask for the move-in inventory you both signed at the leave and license registration, that's your proof the paint was already worn.

Just get the leave and license registered, that's the actual leverage.

Agreed, but the letter should go by registered post with acknowledgement due, that paper trail is what the authority actually weighs.

arrow_drop_up 5 arrow_drop_down

Image isabelle local ·

also send the letter through a lawyer's notice on letterhead, landlords tend to settle faster when it comes from an advocate

Image myriam local ·

the 500 buck stamp paper only matters if the agreement was actually stamped at registration, otherwise it's a xerox with a notary seal & he'll argue it's unenforceable

arrow_drop_up 5 arrow_drop_down

Image janette local ·

but only if the agreement was registered, else the deposit clause is basically toilet paper and he knows it

file it at the Bandra court's small causes division, the deposit cap rules there are stricter than people think.

The Delhi rate applies to you, since Indian nationals pay the domestic ticket at the City Museum regardless of state.

arrow_drop_up 5 arrow_drop_down
Image emily local ·

Yep, and the foreign national rate runs around 500 rupees, so nothing changes for you.

Yeah, student rate is like half that with ID.

Carry your Aadhaar or passport, they check at the counter.

Passport photo page works too, they don't insist on original.
