Has anyone here sued LEA?

A few people i know went the Untätigkeitsklage route at Verwaltungsgericht Berlin and the pattern is always the same: LEA issues the Bescheid like two days before the Klage is formally served, you never get to a hearing, and the case just dies. So the Klage is really just a cattle prod, not a way to get money out of them.

What nobody mentioned yet: for the financial loss itself, forget §839 BGB and look at §88 SGB X, the social-law Herstellungsanspruch. If the Berater gave you bad info (telling you to find a job in 6 months, then sitting on the Wechsel), you can claim the position you'd be in if they'd acted properly, which in your case means ALG I for those weeks you were eligible but unpaid. That's a different legal track than damages and Sozialgerichte actually grant it sometimes.

Concretely: schriftlicher Antrag auf Herstellung des gesetzmäßigen Zustands, cite the date of the Beratungsgespräch and the name of whoever told you the 6-month thing if you have it. And keep the Fax-Sendebericht, that timestamp is your whole case.

The practical bottleneck in your case is probably not the delay itself but the Arbeitgeberwechsel form landing in the wrong pile. If your new contract started in April and you filed before that, LEA should have treated it as a priority because you're moving off benefits, not onto them. I'd call the specific Leistungsabteilung for your district (the one on your Kundenbetreuer's letter, not the general hotline) and ask them to confirm the Eingangsdatum on record. If it doesn't match your fax confirmation, that's your leverage, because it means the file sat unprocessed rather than being "in Bearbeitung."

One thing people forget: you can request Akteneinsicht under §25 SGB X. It forces them to actually open your file and document where it is. Costs nothing, and once they know you're tracking dates formally, things tend to move within a week or two.

honestly suing LEA for delay is really hard because they have a legal defense built in, the "angemessene Bearbeitungszeit" thing. courts usually toss these out unless you can show they sat on it way past normal. 11 weeks for a Verpflichtungsantrag or Arbeitgeberwechsel is annoying but not yet in "obviously negligent" territory from what i've seen.

what actually moves them is a Untätigkeitsklage at Verwaltungsgericht after 3 months of no decision, but you need proof you asked. fax helps actually, keep the Sendebericht. also try the Beschwerdemanagement at LEA and your local Bezirksamt or the Ombudsmann, sometimes a push from there unblocks teh file faster than a lawyer letter.

for the money side, check if you can get ALG I retroactively from the day your eligibility started, not from when they process it. that backdating is often the real fix rather than damages.

Worth noting that Berlin street names have official umlaut and ß rules that trip people up, so a sign showing "Strasse" versus "Straße" is not actually a spelling error, just an older transcription. Same with "ue" versus "ü" (e.g. "Kantstrasse" vs "Kantstraße"), both are considered valid renderings and you'll see the ß version on the blue Schilder and the ss version on older plaques or in databases that predate Unicode. If the difference you're seeing is between those two forms, there's nothing to fix and both are technically correct.

if the signs u mean are the old enamel ones on the house facades those are often protected as Baudenkmal so nobody's allowed to correct them even if the spelling is outdated. the binding version is whatever is in the Berliner Strassenverzeichnis plus the entry in the Liegenschaftskataster, so if u tell me the street i can point u to the right Bezirksamt Mitte or Charlottenburg-Wilmersdorf page. tbh the merged district thing is real but the facade signs are a separate story, theyre basically museum pieces at this point

honestly thats super common in Charlottenburg, the district offices were merged from older Bezirke and nobody ever fixed all the Schilder. if its a real street you can check the official strassenverzeichnis on berlin.de, that list is what the Burgeramt actually goes by. which street is it? some of the Kaiserdamm / Kantstrasse signs are notorious for this.
